Federal Judge Mandates Release of Abrego Garcia from ICE Detention

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without legal authority.

"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case originates in a erroneous deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his return to the United States to face human smuggling allegations, he was held in immigration detention.

In her order, the judge noted that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
